1) If a player has been attacked too many times recently and no one can attack them, they should not be able to attack either, or at east can only attack 2~3 times.
2) The fact that some little runt of a player can attack me 12 times in a row, but I get a "your generals refuse to attack" message when I try to retal is pure bull. If they're too small for me to attack, they should be too small to attack me. If they can attack me, I should be able to retal.

1) If someone is maxed out and they attack, their attacks against level decreases by 2. So, technically, you should be able to attack them, unless someone else maxed them out first. So, even if your idea was implemented, the current situation simply would not change.
2) The net difference allowed is equal both ways. The only thing I can think of is that the empire had a large enough net to attack you, and then dropped themselves to a lower level. That, or they attacked you and suffered troop losses until their networth was too low to continue.
The whole maxing thing is mainly to allow for a balance of power between clans and indies. Without some sort of advantage in favour of unclanned empires, clans would reign supreme to the exclusion of all else.

If you got the "your generals refuse to attack" message it's not bcause of the hit limit, it's because of the net range. It's either because you're both in clans and he has your clan set to war but your clan is not at war with his, or his net dropped below 1/10th of your net. I know the voices in my head arn't real but they usually have some pretty good ideas.
